TableSafe, Inc. (“TableSafe,” “we,” or “us”) is committed to safeguarding your privacy. This Rail Privacy Policy describes TableSafe’s policies and procedures regarding the collection, use, and disclosure of information collected through your use of the TableSafe Rail SolutionTM product (“Rail”).

This policy applies to information that we collect when you use Rail. This policy also applies to additional information that we collect if you choose to provide us with your email address or mobile phone number. However, this policy does not describe the practices of third parties, such as restaurants or online reservation services, that may collect information from you when you interact with them through their websites. We encourage you to ask them about their privacy practices before providing any information to them.

We may change this policy from time to time. If we make changes, we will (a) post the updated policy on the website and (b) revise the “Last Updated” date above. In addition, if you have provided us with an email address or mobile phone number, we will attempt to send you an email and/or text message that notifies you of a link to a page that describes the changes. You should review this policy from time to time to stay informed about our information practices and about ways you can help to protect your privacy.

About Rail

Rail is a product that allows you to pay your restaurant bill by self-swiping your credit or debit card at your table. Rail also allows you to split bills, calculate tips, and have receipts emailed or texted to you in lieu of paper receipts. Relative to standard restaurant industry practice, Rail provides a high degree of fraud protection because (a) Rail does not store credit and debit card primary account numbers, (b) Rail uses point-to-point encryption for all cardholder data, and (c) neither the restaurant nor TableSafe has the capability to decrypt any credit or debit card data.

We Collect Information You Provide to Us

We will collect the information that you provide to us. Typically, the personally identifiable information that you will provide to us will be your email address or your mobile phone number, which we must have to satisfy your request that we deliver your restaurant receipt by email or text message. However, we also may collect additional information that you provide to us if you participate in a promotion or contest offered by us or our partners, respond to surveys, or otherwise communicate with us. This information may include your name, physical address, phone number, and birth date and other historical, contact, and demographic information.

When you self-swipe your credit or debit card through Rail, we do not collect or store any primary account numbers associated with the card.

We Collect Information from Your Use of Rail

We will collect non-personally identifiable information whenever you use Rail. This information will include, without limitation, the following:

precise information about when, where, and at what time the transaction occurred;

a detailed description of the transaction (including, without limitation, a description of each food and beverage item that you purchased); and

a detailed description of the payment amounts, such as amounts payable for food, beverages, tip, and taxes.

This information will be associated with personally identifiable information that we have about you by virtue of your request to receive your restaurant receipt by email or text message.

Promotions, Advertisements, and Analytics

Through Rail directly or through an electronic receipt that you request through Rail, we may allow you to participate in promotions, contests, or surveys. In addition, Rail may contain advertisements. If you participate in these activities, request additional information, or provide your email address or mobile phone number in response to these activities, we or the applicable third-party promoter or advertiser may contact you using that information. If you click through a link to our website or to a third-party website, those websites may use cookies, web beacons, and other technologies to collect information, such as your IP addresses, identifiers associated with your mobile device or applications on the device, the browsers you use to visit the website, pages viewed, time spent on pages, links clicked, and conversion information. This information may be used by us or by third parties to analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests, and better understand your usage.

This policy does not apply to, and we are not responsible for, third-party cookies, web beacons, or other tracking technologies and we encourage you to check the privacy policies of any third party to learn more about its privacy practices.

Use of Information

We use information about you to provide, maintain, and improve Rail and our other products and services and to deliver the information you request, including restaurant receipts. In addition, we use information about you to provide technical notices, security alerts, and support and administrative messages.

We also use information about you to improve and personalize Rail and our other products and services. For example, when you use Rail to pay your restaurant bill and request that we deliver your restaurant receipt by email, the next time you use Rail, your email address automatically will appear after you swipe your credit or debit card, even though we do not store your primary account numbers or any other number capable of processing a credit or debit card transaction.

We may use information we collect to send you news and information about Rail and to communicate with you about products, services, contests, promotions, incentives, and rewards that are offered by us or our partners.

We also may use information we collect to track and analyze trends and usage in connection with Rail, to process and deliver contest and promotion entries and rewards, to protect our rights or property, to verify your identity, to investigate and prevent fraud or other illegal activities, and for any other purpose disclosed to you in connection Rail.

Disclosing Information

We may disclose personal information about you as follows:

With third parties to provide, maintain, and improve Rail and our other products and services, including, without limitation, service providers who access information about you to perform services on our behalf (e.g., fraud prevention and verification services), and financial institutions, processors, payment card associations, and other entities that are part of the payment process;

With third parties that run promotions, contents, advertisements, surveys, or other events or activities in connection with Rail or our other products and services;

In connection with, or during the negotiation of, any merger, sale of company stock or assets, financing, acquisition, divestiture, or dissolution of all or a portion of our business;

If we believe that disclosure is reasonably necessary to comply with any applicable law, regulation, legal process, or governmental request; to enforce applicable user agreements or policies; to protect the security or integrity of Rail or our other products and services; and to protect us, our users, or the public from harm or illegal activities; and

With your consent.

Aggregated Information

We may disclose or sell aggregated, non-personally identifiable information to third parties, including, without limitation, aggregated information regarding the details of your restaurant transactions. Aggregated information means information that has been stripped of information that potentially identifies you and that has been manipulated or combined to provide generalized, anonymous information. Aggregated information will not disclose you as the source or subject of the information.


We take reasonable security measures, including administrative, technical, and physical safeguards, to help protect personal information from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. However, no data transmission over any network is guaranteed to be 100% secure.

You may opt out of receiving promotional emails or text messages from us by following the instructions in those emails or text messages. If you opt out, we still may send you non-promotional communications, such as messages about your completed transactions or our ongoing business relations, and we still will retain archived copies of information about you and your transactions.

Children’s Privacy

We do not anticipate that Rail will be used by, and we will not knowingly collect personal information from, children under the age of thirteen (13). California law permits residents of California to request certain details about the information that we disclose to third parties for direct marketing purposes.
